This privacy policy (“Privacy Policy”) of RS&A, LLC d/b/a Solutech and each of its affiliates and subsidiary entities (collectively, “Solutech”, “we”, or “us”) describes the information that we may collect when you use the Solutech website at https://www.thesolutech.com/ (the “Website”).  We value the privacy of the visitors to the Website and the users of the services provided thereon.  This Privacy Policy applies to activities Solutech engages in on its Website and activities that are offline or unrelated to its Website.  We are providing this notice to explain our information practices and the choices you can make about the way your information is collected and used.

INFORMATION WE COLLECT AND USE

Personal Information Collected

Through your use of the Website, Solutech will collect “Personal Information,” which refers to non-public information that personally relates to or identifies you (e.g., your name, age, gender, email address, postal mailing address, zip code, home/mobile telephone number, and other similar information).  We expect all of our employees and those with whom we share Personal Information to adhere to this Privacy Policy.

 We only collect Personal Information that you provide to us or that we are authorized to obtain by you or by law.  The types of Personal Information we collect will depend on how you are interacting with us through the Website.  Depending on our interactions, we may collect the following categories of Personal Information:

  • Contact Solutech/Media Inquiries:  When you contact us with a question or inquiry through our “Contact Solutech” or “Media Inquiries” forms, we collect, from you, your identifiers (name, email, phone number) and any other information you choose to include in your correspondence.  We use this Personal Information to respond to your questions or inquiries, troubleshoot where necessary, address any topics you inquire about, and send you marketing emails.  You may opt-out of receiving marketing emails from us by clicking the “unsubscribe” link provided with each email.  Please note that we will continue to send you notifications necessary for the operation of the Website or requested products or services.
  • When we are evaluating potential employment candidates:  We may collect your name, education history, address, phone number, email, employment history, gender, ethnicity, and veteran status from third party recruiters or databases, social and professional networking sites, and common partners/acquaintances to perform searches for potential employment and to communicate with you.
  • When you interact with us through the Website:  We may collect your IP address, information regarding your interaction with the Website, or network location based on your IP address.
  • In operating our business, we may collect Personal Information:
    • In order to operate, evaluate, and improve our business, including improving and personalizing the experience for you and others;
    • Using data analytics, for audit, research, and analysis, in order to maintain and improve our services and to protect people who use the Website;
    • For safety and security, by making sure third parties protect your information, and monitoring the technical functioning and security of our network;
    • For legal and compliance, including complying with applicable laws, regulations, and legal obligations; and
    • In order to protect the rights or property of Solutech, as well as its employees, partners, and people who use the Website.

Solutech may also use your Personal Information collected for the above purposes as described in HOW WE SHARE YOUR INFORMATION.

We do not sell any Personal Information from individuals to third parties.

Other Personal Information Automatically Collected

In addition to the Personal Information you provide to Solutech through the Website, when you use the Website, Solutech automatically collects certain information via cookies and similar technologies.  This information includes each of the following:

  • Usage information.  This includes:  your time of visit to the Website, pages visited, search terms, actions taken, how much time you spend on each page, or customer objects throughout the Website and frequency of access.  We use this Personal Information to: (i) conduct analytics; (ii) enhance user experience; (iii) prevent fraudulent use of the Website; and (iv) diagnose and repair errors.
  • Error information.  In the event of technical errors with the Website, we collect information in connection with an error message including file name, error line number, and any related error message generated by the component that failed.  We use this information to diagnose and repair errors.
  • Device information.  This includes information about the device you use to access the Website, such as browser type, browser language, hardware model, operating system, and your preferences.  We use this Personal Information to: (i) conduct analytics; (ii) enhance user experience; (iii) prevent fraudulent use of the Website; (iv) diagnose and repair errors; (v) remember your preferences; and (vi) provide enhanced functionality.
  • Google Analytics.  For the Website, we use Google Analytics to collect information on your use of the Website in order to improve the Website.  In order to collect this information, Google Analytics may set cookies on your browser, or read cookies that are already there.  Google Analytics may also receive information about you from applications you have downloaded that partner with Google.  We do not combine the information collected through the use of Google Analytics with Personal Information.  Google’s ability to use and share information collected by Google Analytics about your visits to the Website or to another application which partners with Google is governed by the Google Analytics Terms of Use and the Google Privacy Policy, available for review here.  To prevent your data from being used by Google Analytics, you can download the Google Analytics opt-out browser add-on for Google Analytics which can be found here.
  • DoubleClick.  We utilize DoubleClick by Google to serve ads based on a user’s prior visit to the Website.  Each visitor to the Website receives a different cookie, and the information collected by the cookie is used to generate conversion statistics and allows us to see the total number of individuals who clicked on our ads.  The DoubleClick cookie is used by Google in the ads served on the website of its partners, such as those participating in Google certified ad networks.  DoubleClick enables Google and its partners to serve ads to you based on your visit to the Website and other websites on the Internet.  Please review Google’s Privacy Notice for additional information on how Google uses the information collected.  To opt out of targeted advertising by Google and this sharing, you can go to Google’s ad settings or you can install the DoubleClick opt-out add-on here.
  • Google Ads.  We use Google Ads to deliver advertisements to you and to track whether you have interacted with an advertisement we have placed elsewhere on the Internet.  Google Ads stores a conversion tracking cookie on your device when you click on our advertisement.  The information obtained through the cookie is used to generate statistics and allows us to see the total number of users who clicked on our advertisements.  We also use Google Ads to present to users of the Website’s advertisements across the Internet and within the Google advertising network based on their visits to the Website.  For more information, please review Google’s privacy policy available here.  To opt-out of this sharing and targeted advertising by Google, you can go to Google’s ad settings here.
  • Facebook.  We use Facebook Pixel to customize our advertising and to serve you on your social medial based on your browsing behavior.  This allows your behavior to be tracked after you have been redirected to the Website by clicking on the Facebook ad.  The Facebook Pixel stores a cookie on your device to enable us to measure the effectiveness of Facebook ads for statistical and market research purposes.  We do not have access to information collected through the Facebook Pixel.  However, the information collected via the Facebook Pixel, on the Website as well as on other websites on which Facebook Pixel is installed, is also stored and processed by Facebook.  Facebook may link this information to your Facebook account and also use it for its own promotional purpose in accordance with Facebook’s here.  The Facebook Pixel also allows Facebook and its partners to show advertisements on and outside of Facebook.  If you do not have a Facebook account, you can opt-out of Facebook ads through the Digital Advertising Alliance (DAA) here and its AdChoices program.

Other than the opt outs provided, you may disable cookies and limit the collection and use of information through them by setting your browser to refuse cookies or indicate when a cookie is being sent.  For essential cookies, this may restrict some of the Website’s functionality.

HOW WE SHARE YOUR INFORMATION

Solutech shares the personal information identified in this Privacy Policy in the following instances:

  • Within Solutech:  Where necessary, Solutech may share your Personal Information within Solutech in order to efficiently carry out business and to the extent permitted by law.  If we share your information, we will share only the information that is necessary and we will take commercially reasonable steps to make sure that third parties take prudent steps to protect your information.
  • With Service Providers:  Solutech may share your Personal Information with service providers that perform services on Solutech’s behalf.  These service providers include our IT support, maintenance and security, and email providers.  Unless we tell you differently or as described elsewhere in this Privacy Policy, our service providers are not permitted to use your information except to assist us.
  • Changes in Business Structure/Ownership:  In the event that Solutech enters into, or intends to enter into, a transaction that alters the structure of Solutech, such as in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of Solutech’s business, assets, or ownership interest (including any bankruptcy or similar proceedings), Solutech may share your Personal Information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction.
  • For Legal Purposes:  Solutech will share your Personal Information where legally required, including, auditors, government authorities, law enforcement, regulatory agencies, our legal counsel, third party litigants and their counsel, or other authorized individuals in order to comply with laws that apply to us, or other legal obligations such as contractual requirements.

We have not sold any categories of Personal Information within the past 12 months, including children’s Personal Information.

DO NOT TRACK

Some web browsers allow you to turn on Do Not Track (“DNT”), which sends signals to websites you visit, telling those sites that you do not want your online activities to be tracked.  The Website currently is not designed to respond to DNT signals received from web browsers.

INFORMATION SECURITY

We strive to take appropriate security measures to help safeguard your Personal Information from unauthorized access and disclosure.  For example, only authorized employees are allowed to access Personal Information, and they may only access it for permitted business functions.  We also use technology to protect your information, including firewalls and encrypting sensitive Personal Information that is transferred to or from our systems.

While we cannot guarantee that loss, misuse, or alteration will never occur, we use reasonable efforts to prevent it.  Please keep in mind that no method of storage or transmission over the Internet is completely secure, so your use of the Website and provision of information to us is at your own risk.

The Website may contain links to other third-party sites on the Internet.  The information practices of those websites are not covered by this Privacy Policy.  We are not responsible for the privacy policies of other websites.

Responding to Requests:  Your request will be evaluated to determine whether the requested change meets legal regulatory requirements and does not risk making our other data less secure or changing our other data.  After we evaluate your request, we will respond to update you on the status of your request.

Verifying Your Identity: To protect you and your information, we may ask you to confirm certain information before we honor your request.  For example, if you make a request, we will ask you to confirm your name, email address, and/or phone number verify your identity, so that we can help protect your information.  If you designate an authorized agent to make a request on your behalf, we may require you to verify your identity and provide the authorized agent’s identity and contact information to us.

EUROPEAN PRIVACY NOTICE

International Data Transfers

Solutech primarily stores the Personal Information we collect in the United States.  To facilitate our global operations, staff who work for Solutech and/or our service providers may transfer and access such Personal Information from locations around the world.  This will involve transferring your Personal Information outside the European Economic Area (EEA).

We will take commercially reasonable steps necessary to ensure that your Personal Information is treated securely and in accordance with this Privacy Policy.

Whenever we transfer your Personal Information out of the EEA, we will ensure one of the following safeguards is implemented:

  • We will only transfer your Personal Information to countries that have been deemed to provide an adequate level of protection for Personal Information by the European Commission; or
  • We may use specific contracts approved by the European Commission which give Personal Information the same protection it has in Europe; or
  • We will ensure there is some other protection in place which has been approved by the European Commission as giving Personal Information the same protection it has in Europe.

E.U. Privacy Rights

Under certain circumstances, individuals within the European Economic Area have rights under data protection laws in relation to your Personal Information as set out below:

  • Request access to your Personal Information (commonly known as a “data subject access request”).  This enables you to receive a copy of the Personal Information we hold about you and to check that we are lawfully processing it.
  • Request correction of the Personal Information that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your Personal Information.  This enables you to ask us to delete or remove Personal Information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your Personal Information where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your Personal Information to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  • Object to processing of your Personal Information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms.  You also have the right to object where we are processing your Personal Information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Request restriction of processing of your Personal Information.  This enables you to ask us to suspend the processing of your Personal Information in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request the transfer of your Personal Information to you or to a third party.  We will provide to you, or a third party you have chosen, your Personal Information in a structured, commonly used, machine-readable format.  Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

LEGAL BASES FOR PROCESSING

We have set out below a description of some of the legal bases we rely on to process your Personal Information.  Note that we may process your Personal Information for more than one lawful ground depending on the specific purpose for which we are using your Personal Information.  Please email: info@thesolutech.com if you need details about the specific legal grounds we are relying on to process your Personal Information where more than one ground has been set out below.

  • Contracts.  Where we need to perform the contract we are about to enter into or have entered into with you.
  • Legitimate Interests. Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. The following are non-exhaustive examples of where Solutech relies on legitimate interest to process Personal Information:
    • Solutech has a legitimate interest in processing Personal Information during the employee recruitment process and for keeping records of the process.  Processing data from job applicants allows us to manage the recruitment process, assess and confirm a candidate’s suitability for employment and decide to whom to offer a job.
    • Solutech has a legitimate interest in processing Personal Information relating to our customers in order to manage our business relationship and provide communications and information that may be of interest, including marketing communications.
    • Solutech has a legitimate interest in using cookies as outlined above.
  • Legal Obligations.  Where we need to comply with a legal or regulatory obligation.

Generally we do not rely on consent as a legal basis for processing your Personal Information.

DATA RETENTION

We will generally only retain your Personal Information for as long as necessary to fulfill the purposes for which we collected it.

In some circumstances we may anonymize your Personal Information (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

AGE RESTRICTION

The Website is not intended for individuals under the age of eighteen (18).

CHANGES TO THIS PRIVACY POLICY

 We reserve the right to modify or change this Privacy Policy at any time.  When we make a material change to this Privacy Policy, we will inform you by posting a prominent notice on the home page of the website or changing the date on this page noting when the Privacy Policy was last updated.
